2. Platform Overview

MallitShopIt is a community-driven digital platform that combines:

• Social networking features;
• Online shopping through MISI Stores;
• Jobs and career opportunities;
• Property listings;
• Events and community engagement;
• Business and local service discovery.

Products sold through the Platform are managed directly by MallitShopIt through MISI Stores, approved suppliers and authorised distribution channels.

Users are not permitted to create, operate or manage independent online stores on the Platform.

3. Eligibility & User Accounts

By using the Platform, you warrant that:

• You are at least eighteen (18) years of age, or using the Platform with parental or guardian consent;
• You have the legal capacity to enter into binding agreements;
• The information provided during registration is accurate and complete;
• You will maintain the confidentiality of your login credentials.

You are solely responsible for all activities conducted under your account.

MallitShopIt reserves the right to suspend, restrict or terminate accounts that violate these Terms or engage in suspicious, unlawful or harmful activity.

4. MISI Stores & Product Sales

Products displayed on MallitShopIt are sold through MISI Stores and approved suppliers.

MallitShopIt reserves the right to:

• Modify product pricing without notice;
• Limit quantities available for purchase;
• Discontinue products at any time;
• Reject or cancel orders where necessary;
• Correct pricing or product description errors.

Product images are provided for illustrative purposes only and may vary slightly from the actual product received.

5. Orders, Payments & Refunds

All prices displayed on the Platform are listed in South African Rand (ZAR).

Payments are processed securely through approved payment gateways including PayFast, PayGate or other authorised providers.

• Orders will only be processed once payment has been successfully authorised;
• Failed or rejected payments may result in automatic order cancellation;
• MallitShopIt reserves the right to verify transactions for fraud prevention purposes;
• Refunds and returns will be handled in accordance with applicable South African consumer laws.

Customers are responsible for ensuring that payment details and delivery information are accurate at the time of purchase.

6. Deliveries & Returns

Delivery times displayed on the Platform are estimates only and may vary depending on stock availability, courier delays or external factors.

Customers must inspect products upon delivery and report any defects, damages or discrepancies within a reasonable period.

Returns and refunds may be subject to:

• Applicable return periods;
• Product condition requirements;
• Consumer Protection Act provisions;
• Specific product exclusions.

7. Community Conduct & Prohibited Activities

Users may not use the Platform to:

• Post unlawful, harmful or offensive content;
• Harass, threaten or abuse other users;
• Upload malicious software or harmful code;
• Impersonate individuals or businesses;
• Distribute spam, scams or misleading information;
• Attempt unauthorised access to systems or data;
• Violate any applicable South African laws or regulations.

MallitShopIt reserves the right to remove content, restrict functionality or terminate accounts that violate these rules.

8. Intellectual Property

All trademarks, branding, software, graphics, content, designs, logos and intellectual property displayed on the Platform remain the property of MallitShopIt (Pty) Ltd or its licensors.

Users may not reproduce, distribute, copy, reverse engineer or commercially exploit any part of the Platform without prior written consent.

9. Privacy & Data Protection

MallitShopIt processes personal information in accordance with:

• The Protection of Personal Information Act (POPIA);
• The Electronic Communications and Transactions Act (ECTA);
• Applicable cybersecurity and privacy regulations.

By using the Platform, you consent to the collection, processing and storage of personal information required for operational, security and service-related purposes.

10. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, MallitShopIt shall not be liable for any indirect, incidental, consequential or special damages arising from:

• Use or inability to use the Platform;
• Interrupted or unavailable services;
• Unauthorised access to accounts or data;
• Third-party services or external links;
• Errors, delays or technical failures.

Users agree to indemnify and hold harmless MallitShopIt, its directors, employees, contractors and affiliates against claims arising from misuse of the Platform or violation of these Terms.

11. Suspension & Termination

MallitShopIt reserves the right to suspend, restrict or terminate access to the Platform at its sole discretion where users:

• Violate these Terms;
• Engage in fraudulent activity;
• Compromise platform security;
• Abuse or misuse platform services.

Legal action may be taken where necessary.

12. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising from use of the Platform shall fall under the jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg.
